The Serbia-China FTA from 1 July 2024 can lower duty. Can, not must. Without a correct certificate of origin (COO), duty runs as if the agreement did not exist.
Wider frame: Serbia-China FTA. Here is the operating sequence.
1. HS code before the PO
Preference depends on the tariff number and liberalisation category (A0, A5, A10, A15, exceptions). A wrong HS at customs costs time and money. Align it with the forwarder before loading, not in Batajnica.
2. Origin must be Chinese under the agreement rules
A COO is not a “Made in China” sticker. It must follow the FTA protocol. A generic CCPIT paper is not always enough. Check with the forwarder which form applies to this shipment.
People often say Form E. For Serbia-China use the form the agreement and Customs recognise at the moment of import. Do not copy EU Form A habits.
3. Factory / exporter must issue it on time
COO is requested in China, with invoice and packing list. If you ask when the vessel is at sea, it is often late. Papillon, in agreed sourcing-execution scope, pushes COO into the document pack before shipment.
4. Data must match
Importer name, goods description, HS, quantities, invoice. Mismatch = Customs can refuse preference. That is not a “small translation issue”.
5. The broker claims the preference
In Serbia commercial import goes through a broker (JCI). You do not stand at the counter alone. The broker must have COO in the file. See customs broker and JCI.
What Form E is not
Not a guarantee of zero duty. Not a substitute for landed cost. The rate depends on HS and on whether Customs accepts the certificate. Without the paper, standard duty remains.
Without COO, import from China still works. You only pay more.
Where the sequence breaks
COO is late for three reasons, none of them at Serbian customs. First: HS is not closed before the PO, so the exporter does not know which form to request. Second: the factory and the company on the invoice are not the same account, so origin hangs. Third: the paper is requested after sea has started. Sea is about 35–52 days. A certificate that starts a week later often arrives as a correction, not as an attachment to the filing.
In the brief, during 1–3 weeks of shortlist, HS is checked with the broker as an assumption. The PO states that COO goes before loading if you count on the 1 July 2024 agreement. A 2–5 week sample does not produce a certificate. The certificate follows the series, with invoice and packing list. QC (standard above 2,000 USD) still looks at goods. COO looks at paper. Both pass before seal, or the quote keeps standard duty.
LCL from three factories: each line carries its own shipper. One COO on someone else’s cargo does not cover yours. FCL does not forgive a mismatch because it is one vessel. CBM does not change origin. It changes freight. VAT is not an FTA saving.
If the exporter cannot say which form applies to Serbia-China, if the certificate description cannot follow the invoice, or if the HS line has no preference and the paper is only mentioned to make chat price look lower, drop the lower-rate story.
If the paper does not arrive, say so before the balance. Goods without a certificate can still be imported. They enter the warehouse at the other duty, and that duty must already sit in the quote. You are the importer. Papillon, when it runs sourcing, pushes the certificate into the pack before loading. It does not file the declaration in place of the broker.
